1. Who we are and what these terms cover

ESLStudeo is run from Morocco by its founder and developer, Omar Ben Jilali. In these terms, "we" means ESLStudeo. The terms cover eslstudeo.com, the ESLStudeo app, the websites that organizations run at their own web address through ESLStudeo, and the ESLStudeo connector for AI assistants.

Three words have a fixed meaning here. An organization is a school, a language centre, a company or an independent teacher that runs classes on ESLStudeo. A learner is a person who takes courses or tests on ESLStudeo. Content is anything a person creates or uploads, for example a course, a test, a picture, a recording, an answer or a post.

By creating an account, or by using ESLStudeo, you accept these terms. If you use ESLStudeo through an organization, that organization's own rules also apply to you.

2. Accounts

• Give true information when you create an account, and keep it up to date.
• Each account is for one person. Do not share your password. You are responsible for what is done with your account.
• If you believe that someone else has used your account, change your password and write to us.
• An organization that gives accounts to learners is responsible for those accounts. It decides who receives one, it obtains any consent the law requires (including a parent's consent for a learner under 18), and it removes accounts that are no longer needed.
• An account that a person creates for themselves, without a class code or an invitation from an organization, is reviewed by the ESLStudeo team before it opens. Such accounts are intended for adults.

3. Your content

• You keep the rights to the content you create.
• You allow ESLStudeo to store, copy, show and process your content only as far as is needed to run the service. For example, we show a course to the learners you give it to, keep backup copies of it, and turn its text into speech when you ask for it.
• When you share or sell a course or a test to another organization, that organization may use it with its own learners, in the way you chose when you shared it.
• Upload only content that you have the right to use. Do not upload another person's pictures, recordings, texts or book pages unless the owner or the law allows it.
• A learner's answers and work are theirs. The learner's teachers and organization can see and mark them, as the privacy policy explains.
• We may remove content that breaks these terms or the law. When we can, we tell the account holder first.

4. Acceptable use

You must not:

• try to reach an account, a class or data that is not yours, or test the security of ESLStudeo without our written permission;
• disturb the service, for example by sending large numbers of automated requests, or copy its content with automated tools;
• post content that is unlawful, hateful, harassing or sexual, or that reveals another person's private information;
• take a placement test, a graded unit or an exam in another person's place, or give another person the answers to an exam;
• use ESLStudeo to send advertising or messages that the recipients did not ask for.

5. Artificial-intelligence (AI) features

• Some features use AI to draft activities, questions, audio and pictures, or to suggest a mark. AI output can be wrong. The teacher who uses it is responsible for checking it before learners see it.
• A suggested mark is only a suggestion. The teacher decides the mark.
• Do not put personal information in a request to an AI feature unless the request needs it.
• A teacher who connects an AI assistant to ESLStudeo through the connector is responsible for what the assistant does with the permissions the teacher gives it.

6. Placement tests

A placement test gives an organization information for deciding a learner's level. The organization decides the level. We do not guarantee that a test result is right for a particular person.

7. Payments

• Most of ESLStudeo is free. Some features, plans and courses must be paid for. What each one includes, and its price, are shown before you pay.
• Payments are taken by PayPal or Stripe, under their own terms.
• To ask about a payment, or to ask for a refund, write to contact@eslstudeo.com. Nothing in these terms removes a right that the law gives you as a buyer.

8. Availability and changes to the service

We work to keep ESLStudeo available and your data safe, and we copy the database every night. We cannot promise that the service will never be interrupted or never have faults. We may change, add or remove features. When a change removes something that people rely on, we announce it in advance whenever we can.

9. Suspending and closing accounts

• You may stop using ESLStudeo at any time. To have your account deleted, ask your organization, or write to us.
• We may suspend or close an account that breaks these terms, puts other people at risk or is used unlawfully. Except in urgent cases, we first tell the account holder and explain why.

10. Limits of our responsibility

ESLStudeo is provided as it is. As far as the law allows, we are not responsible for indirect losses, such as lost income or lost opportunities, and our total responsibility for any claim is limited to the amount you paid ESLStudeo in the twelve months before the claim. This section does not limit any responsibility that the law does not allow to be limited.

11. Law and disputes

Moroccan law governs these terms. If a disagreement arises, write to us first, so that we can try to settle it. If it cannot be settled, the competent courts of Morocco will decide it.

12. Changes to these terms

When these terms change, we update this page and the date at its top. If a change is important, we tell account holders in the app or by email before it takes effect. If you continue to use ESLStudeo after that date, you accept the new terms.
